Fraser Simpson v CPAO litigation update: a must read for all CPA's and litigation lawyers.

This week the CPAO filed a motion to secure costs for the upcoming appeal to be heard this November 26th at Osgoode Hall. I invite everyone to attend and watch me perform my magic. Robert Rueter, or Bob as I like to call him was his usual incompetent dufus self. He spent 3 days and $25,000 on a frivolous motion where merit was previously ruled on by Justice Van Rensburg. Guess he needs the money. Next week we get the decision by Justice Epstein.

To date the clowns at the CPAO have spent in excess of $250,000 defending an action with respect to the payment of my professional fees 6 years ago. Why? Because if they don't they will be liable for negligence and have to cut me a sizable cheque (cash please, large bills).

To all CPA's I invite you to question the executive and question the validity of spending over $250,000 to pursue an action related to a 4,000 professional fee.

Summary of the facts; (details are available on request)

  • Marshall Sone paid my professional fees by credit card in Jan 09
  • Sone (a convicted fraudster and Fog Horn Leg Horn look-a-like) committed credit card fraud and stole the fees from the CPAO I April of 09
  • The CPAO then requested the funds from me which I politely advised them to kiss my ass. They took offense and decided to engage me in a litigation battle instead of reporting the Sone fraud to the appropriate authorities.
  • During litigation it was revealed that the CPAO did not prepare a sales draft for the Sone credit card payment because they, well, forgot. That is what we call in legal circles-NEGLIGENCE.
  • the CRA has provided a ruling in which they validate my professional fees as being paid.
  • the CPAO and Bob have declared the CRA ruling without authority. We shall see what 3 sober judges think come appeal time.
Look for my update next week as we get closer to crunch time and the 11th hour things should get interesting.
