The Devil is in the details...Harvard lawyer promotes fraud and misleads CPAO council.

Recently I sent an email to Timothy Kennish to look into the Marshall Sone fraud and negligence by the CPAO in handling the credit card charge back. Kennish acknowledged that the CPAO should have responded to Global Payments Direct and should have prepared a sales draft as required by the merchant agreement. Kennish also acknowledged the Gubbins perjury.

The question remained: what was Kennish going to do about it? Kennish eventually tried to bury the issue in the hope that it would go away. Kennish was nearing the end of his term on council and recently retired. He did not want to get involved in a protracted dispute in which his own competency would be questioned.  Late in 2013 an independent investigation by the CPAO Audit Committee was conducted to review the Sone fraud and the executive conduct resulting in the subsequent negligence.  This report was to be transparent and issued publically to once and for all deal with the Sone fraud scandal.  After the investigation the report was buried by Council and privilege claimed - buried by Kennish!!

Kennish did not want to take action because he knew that his own reputation was on the line. In fact, he knew that he should not even be communicating with me while the issue was before the courts. He should have referred me to the CPAOs legal representation Robert Rueter.  Why did Kennish correspond with me by email? He had hoped that he could convince me to drop my claim against council and therefore save his own neck. He was desperate. His reputation in jeopardy and already retired. It takes a lifetime to build a reputation and one negligent investigation to ruin it.

Kennish should be ashamed of himself. He was in a position of authority mandated to ensure the executive were conducting their fiduciary duty appropriately. Kennish knew fraud had occurred, that the executive were negligent in handling the credit card charge back and that Gubbins committed perjury. Yet Kennish did nothing!  An innocent man was going to lose his livelihood and all he could think about was his own skin!

Kennish should be reprimanded and a formal review of council independence should be conducted.
